Call For Action Online Privacy Policy

Call For Action, Inc. (“CFA”) is committed to protecting consumer privacy online.  We believe that greater protection of personal privacy will not only protect consumers, but also increase consumer confidence and ultimately consumer participation in online activities.  This Privacy Policy describes our practices in connection with information that we collect through websites operated by us from which you are accessing this Privacy Policy (the “Websites”). By using our Websites, you agree to this Privacy Policy.

PERSONAL INFORMATION

“Personal Information” is information that identifies you as an individual or relates to an identifiable individual.  We collect Personal Information that you provide to usin connection with our online complaint form, which may include:

  • Name;

  • Telephone number(s);
  • Email address; and
  • Other Personal Information included in the “Problem Description” or “Action Requested” sections of the complaint form.

We and our service providers may use Personal Information to:

  • Process the complaint(s) you have submitted to us;
  • Contact you from time to time regarding your complaint;
  • Respond to other requests you may have;
  • Send administrative information to you, such as changes to our terms, conditions, and policies,
  • Send surveys to you;
  • For our business purposes, such as data analysis, audits, fraud monitoring and prevention, improving or modifying our Websites, identifying usage trends, and operating and expanding business activities.

If you submit any Personal Information relating to other people to us in connection with the Websites, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

  • Volunteers responsible for responding to your complaint;
  • The business organization or agency that is the subject of your complaint;
  • News or other media organizations, if you indicate on the complaint form that you would be willing to talk to the media about your complaint; and
  • Third-party service providers for the purpose of providing services to us, such as Websites hosting, information technology consulting services, data analysis, legal or audit services, accounting services, and other services.

Other Uses and Disclosures

We may also use and disclose your Personal Information as we believe to be necessary or appropriate: (a) to comply with applicable law, to respond to requests from public and government authorities, to cooperate with law enforcement, or for other legal reasons; (b) to enforce our terms and conditions; and (c) to protect our rights, privacy, safety or property, and/or that of our affiliates, you, or others.   • Using cookies. Cookies are pieces of information stored on the computer that you are using.  We use cookies when you access our Websites to keep track of the state of your visit to the Websites (for example, to facilitate navigation). 
  • Analytics.   • Aggregate information. We may aggregate information submitted from complaints in a manner such that it no longer reveals your specific identity. We use aggregate information to measure relative consumer awareness in the various areas of consumer education and gauge the overall numbers affected by specific consumer problems.

Please note that we may use and disclose Other Information for any purpose.

THIRD PARTY SERVICES

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any website or service to which the Websites link.  Please review any third-party privacy policies to learn how they handle your Personal Information.

SECURITY

We use reasonable organizational, technical, and administrative measures designed to protect Personal Information within our organization.  Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure.  If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “Contacting Us”section below.

CHOICES AND DELETION

USE OF WEBSITES BY MINORS

The Websites are not directed to individuals under the age of thirteen (13) and, we do not knowingly collect Personal Information from individuals under 13.

JURISDICTIONAL ISSUES

The Websites are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States.

UPDATES TO THIS PRIVACY POLICY

We may change this Privacy Policy.  The “Last Updated” line at the top of this page indicates when this Privacy Policy was last revised.  Any changes will become effective when we post the revised Privacy Policy on the Websites.  Your use of the Websites following these changes means that you accept the revised Privacy Policy.

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Termination

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.
